Treat succession as operational resilience
The file is not a substitute for wills or legal advice. It ensures that authorised people can identify the property, protect it, communicate with professionals and begin the correct legal process. Build it while the owner can verify facts.
Coordinate Japanese and home-jurisdiction advice. Cross-border succession can involve different concepts of governing law, heirs, wills, tax and document form.
Record ownership precisely
Keep current registry, purchase contract, ownership shares, land rights, address history, identity and entity records. Explain whether property is held individually, jointly, through a company or subject to trust or nominee questions. Record mortgages, guarantees and security.
Do not assume family members know the Japanese address or which unit, parking and land rights are included.
Identify legal documents and advisers
List wills, choice-of-law or estate documents, powers effective during incapacity, family register or foreign civil-status records, translations and their storage. Name Japanese and overseas lawyers, judicial scrivener and tax advisers with engagement scope.
Have professionals confirm which originals, apostille, notarisation and translations may be required. Do not create informal documents that contradict the estate plan.
Preserve urgent operating access
List manager, tenant, association, insurer, lender, utilities, keys, security and emergency contractors. State who may enter, spend and give instructions during incapacity or after death under valid authority. Maintain cash for tax, charges, insurance and protection.
Do not put raw banking passwords or authentication codes in a broadly shared file. Use secure access and a documented recovery process.
Reconstruct tax and value
Keep acquisition price and allocation, taxes, registration, brokerage, improvement invoices, depreciation, annual filings and debt balances. Maintain a current property description and evidence-led value range, but label the date and method.
Japanese inheritance and gift tax exposure depends on facts and can change. Obtain current advice and update after residence, nationality, family, ownership or law changes.
Review after every life change
Update after marriage, divorce, birth, death, relocation, citizenship or residence change, acquisition, refinance, major work, new will or adviser change. Date every version and destroy obsolete unsecured copies appropriately.
Test the file annually with the named coordinator: can they find the property, protect it for thirty days and contact the right Japanese professionals? If not, the plan is incomplete.
Create a thirty-day action page
The front page should state whom to contact first, property and insurer identifiers, manager and tenant status, urgent payments, key location, known works and the professionals who decide legal and tax steps. It should not instruct an unauthorised family member to transfer, sell or enter property. Its purpose is protection and coordination while authority is confirmed.
Run a tabletop test with the named coordinator: the owner cannot respond, a tax notice arrives and a leak is reported. Ask what the coordinator may lawfully do, which records are missing and how cash is accessed. Correct the file and professional arrangements after the test. Practical resilience is measured by a safe response, not by the number of documents stored. Have the Japanese and overseas advisers review the same ownership chart so contradictory assumptions are identified. Record advice dates and trigger a new review after family, residence, ownership, debt or law changes.
Confirm the secure access method and coordinator contact annually.
